Phil Gibbons Law Handles Individual and Class Action Employment Lawsuits.
Individual Employee Lawsuits
Our Charlotte, North Carolina employment lawyers represent employees in individual claims, including claims for unpaid minimum wages, overtime pay and other wages (commissions, bonus pay and vacation pay), Equal Pay Act claims for pay discrimination, and Family and Medical Leave Act (FMLA) claims. On a very select basis, we handle discrimination claims based on race, national origin, gender, age and disability, including claims for unlawful harassment and retaliation.
We handle individual employee lawsuits on a combined retainer/contingency basis. Our goal is to limit your out-of-pocket risk if we agree to accept your case. We are very selective about the lawsuits we accept and dedicate as much time as necessary to help our clients resolve their employment disputes. By selecting you as a client, we are foregoing accepting other clients who wish to utilize our services. For this reason, we charge a retainer of $375 at the time you hire our law firm, plus $45 each month until your case is resolved. Any other fees we earn are based on the results of your case and paid as a percentage of the recovery. If there is no recovery, you only pay the retainer fees described above.
Class and Collective Action Lawsuits
Phil Gibbons Law is nationally recognized for collective action and class action litigation under the Fair Labor Standards Act (FLSA) and state wage and hour laws that protect the rights of employees to be paid minimum wages, overtime pay, and other earned wages and compensation. We represent workers in wage and hour lawsuits throughout North Carolina and the United States on a contingency basis. We help employees recover all the pay they are legally owed, plus additional damages and penalties provided by law. We also represent workers who have been treated as independent contractors. We have recovered millions of dollars in unpaid wages for employees nationwide. We do not charge any out-of-pocket fees if we represent you in a class or collective action lawsuit.
Review of Employment Agreements, Severance Documents, Non-Competition Agreements, or other Employment Contracts.

Some clients request that we contact their employers to discuss or negotiate issues relating to employment agreements. Fees for this type of legal work typically range from $1500 to $3,000.
